Consumer Health Data Privacy Policy

This policy supplements our Privacy Policy and is provided under Washington's My Health My Data Act, Nevada SB 370, and Connecticut's consumer health data provisions. It describes the health-related information we collect, why, who receives it, and the rights available to you.

We do not currently offer our questionnaire to residents of Washington, Nevada, or Connecticut. This policy is published so that our practices are transparent, and it applies to any consumer health data we do hold about a resident of those states.

1. What we mean by consumer health data

These laws define consumer health data broadly: information linked to you that identifies your past, present, or future physical or mental health status. On this Site that means your answers about your medical condition, whether you are under treatment or taking medication, how long you have been or expect to be unable to work, and the fact that you are seeking Social Security Disability benefits, which itself signals a health condition.

We do not collect medical records, test results, clinical documentation, diagnoses from a provider, biometric data, or precise location for health purposes. Please do not send us medical records.

3. Why we collect it

  • To assess whether you may meet general eligibility criteria for Social Security Disability benefits;
  • To pass your request to a participating law firm or advocate so they can contact you about representation;
  • To keep a record of your consent, as the law requires;
  • To detect fraudulent or duplicate submissions.

We do not use consumer health data for advertising, and we do not use it to infer characteristics about you beyond the eligibility assessment described above.

4. Who we share it with

We do not share consumer health data with advertising or analytics partners, and we do not sell it. Under these laws, a "sale" of consumer health data requires separate written authorization; we do not sell consumer health data and do not seek such authorization.

5. Consent

We collect consumer health data only after you affirmatively provide it by answering our questionnaire and submitting the form. We collect only what is necessary for the purposes in §3.

6. Your rights

  • Right to know and access: to confirm whether we hold consumer health data about you, to see it, and to receive a list of the third parties it has been shared with, including how to contact them.
  • Right to withdraw consent: to withdraw your consent to our collection and sharing of your consumer health data.
  • Right to delete: to have your consumer health data deleted from our records and, on our notification, from the records of those we shared it with.
  • Right to appeal: if we decline a request, to appeal that decision.

7. How to exercise your rights

Email privacy@legalleadaxis.com with the subject line "Consumer Health Data Request" and tell us which right you are exercising, your full name, the phone number and email address you submitted, and the state you live in. You may also write to us at the address below.

We confirm receipt within 10 business days and respond within 45 calendar days, extendable once by a further 45 days with notice. There is no charge, and we will not treat you differently for making a request.

8. Deletion, and its limits

When you ask us to delete, we delete your consumer health data from our active records and notify any law firm, advocate, or service provider that received it, asking them to do the same. Two limits are worth stating plainly:

  • We retain your consent record, including the TrustedForm certificate, because the law requires us to be able to prove that you consented to be contacted. That record is kept only for that purpose.
  • A law firm or advocate that already received your information holds their own copy under their own legal and professional obligations. We will notify them, but you may also contact them directly.

9. Appeals

If we deny your request, email privacy@legalleadaxis.com with the subject line "Privacy Appeal." We will respond within 45 days with our decision and the reasons for it. If we deny the appeal, you may contact your state Attorney General.

10. Security and retention

Consumer health data is protected by the safeguards described in our Privacy Policy §11, including encryption in transit, access controls, and vendor due diligence. It is retained for 3 years from your last interaction unless you ask us to delete it sooner. Consent records are retained for 5 years.

11. HIPAA does not apply

We are not a health care provider, health plan, or HIPAA-covered entity. The health-related information you give us is not protected health information under HIPAA. It is handled under this policy, our Privacy Policy, and applicable state law.
